Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Traceflow platform operated by PaceForms Inc. ("Traceflow," "we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing our website at gettraceflow.com, or using the Traceflow platform (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

Traceflow is a customer journey analytics platform that helps businesses track and analyze the complete journey their customers take — from email interactions to website behavior — using email address as a single unifying identifier. The Service includes:

  • Customer journey timeline dashboard
  • Website behavior tracking via JavaScript snippet
  • Email integration (Gmail, Outlook)
  • Real-time heatmaps and engagement signals
  • Website analytics (visitors, sessions, traffic sources, locations)
  • Multi-website configuration

3. Account Registration

To use Traceflow, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Immediately notifying us of any unauthorized use of your account
  • Ensuring your account information remains accurate and up to date

4. Subscription and Billing

Traceflow offers subscription plans with different features and limits. By subscribing to a paid plan:

  • You authorize us to charge your payment method on a recurring basis (monthly or annually, as selected)
  • Subscription fees are non-refundable except as expressly stated in these Terms or required by applicable law
  • We may change subscription prices with at least 30 days' advance notice; your continued use after the price change takes effect constitutes acceptance
  • You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period

All fees are exclusive of applicable taxes. You are responsible for all applicable taxes.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms. You must not:

  • Use the Service to collect personal data without proper consent from individuals
  • Track website visitors without disclosing this in a clear Privacy Policy and obtaining required consents under GDPR, CCPA, or applicable privacy laws
  • Use the Service to spam, harass, or send unsolicited communications
  • Attempt to reverse engineer, decompile, or extract the source code of the Service
  • Resell or sublicense access to the Service without our written permission
  • Use the Service in a manner that violates any applicable law or regulation
  • Introduce malware, viruses, or any other harmful code
  • Circumvent any security features or access controls of the Service
  • Use the Service to collect data about children under 16 years of age

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

Your data ownership: You retain ownership of all data you input into or collect through the Traceflow platform. By using the Service, you grant us a limited license to process your data solely for the purpose of providing and improving the Service.

Your responsibility as data controller: If you use the Traceflow tracking script on your website, you are the data controller for your visitors' data. You are responsible for:

  • Providing adequate notice to your website visitors about the use of tracking technologies
  • Obtaining appropriate consents under GDPR, CCPA, or other applicable privacy laws
  • Maintaining a Privacy Policy that discloses the use of Traceflow
  • Entering into a Data Processing Agreement (DPA) with us if required by applicable law

7. Intellectual Property

The Traceflow platform, including its software, design, trademarks, and content (excluding your data), is owned by PaceForms Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our platform without our prior written consent.

We grant you a limited, non-exclusive, non-transferable license to access and use the Service during your subscription period, solely for your internal business purposes.

8. Confidentiality

Each party agrees to keep confidential any non-public information received from the other party that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information and the circumstances of disclosure.

9. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PACEFORMS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless PaceForms Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Service in violation of these Terms
  • Your violation of any third-party rights, including privacy rights
  • Your failure to comply with applicable privacy laws when using the tracking script

12. Termination

We may suspend or terminate your account at any time for violation of these Terms, upon 30 days' notice for any other reason, or immediately if required by law. You may terminate your account at any time through your account settings.

Upon termination, your access to the Service will cease. We will retain your data for 90 days after termination, after which it will be permanently deleted.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email and by posting the updated Terms on this page. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
